Welcome to The Mafia Network 2010! Before you register for your account, you must read and agree to this TMN Terms of Service and the included privacy policy, including any future amendments (collectively, the “Agreement”). If you'd like to read this document in another language, you can use Google Translate to translate the text, although we will not be responsible for inaccurate results of this third party service.
1. ACCEPTANCE OF TERMS
The Mafia Network 2010 staff (“TMN2010”, “TMN”, “Administrators”, “we”, “us”, "Bitter IT") welcomes you (“players”, “users”) to this old but renewed online game. Throughout the round we will provide a service to you, subject to the following Terms of Service (“TOS”). We reserve the right to modify the TOS whenever necessary with or without notice, at the bottom of the page you will find the last time it was updated. Please review the TOS often so that you will be apprised of any changes. By using the service provided by TMN, you agree to the TOS, and its terms and conditions. You can view the most current version of the TOS at any time at: tmn2010.net/tos.htm.
2. DESCRIPTION OF SERVICE
We provide users with access to an online service, presented in form of a community and an interactive text-based browser-game. You understand and agree that the Service may include advertisements and that these advertisements are necessary for us to provide the Service. In addition, you understand and agree that the Service is provided on an as is and as available basis. Bitter IT, owner of TMN2010, disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Service. We also disclaim all responsibility and liability for the timeliness, deletion, delay or failure to store any user communications, user data or personalization settings. This service is provided as a beta version, which means we absolutely have the rights to make necessary changes with or without major improvements to the service. We also reserve the right to terminate services from time to time, for any reason, and without notice, without liability to you, any other user or any third party. We also reserve the right to change any content (this includes any rules, game content, service features, or any other content based on the service) with or without notice or any liability to the users. You also agree to pay attention to service news and any messages announced by TMN staff members using the known internal and external media including the News Page, Game Forum and the TMN Staff Blog.
3. CREDITS
The user can use Paypal's secure online payment system to buy virtual credits, that can be used in-game. Payments for credits are considered payments for the service, and go to the Netherlands-based company Bitter IT (registration number: 51818124), provider of the TMN2010 service. This company is owned by Marc Bitter, who is also in charge of TMN2010. The money from credits is used for server and service maintenance in sole responsibility of Bitter IT. In the game, credits can be used to buy special items in the Credits Shop (a feature of the Service). For more information on how to receive or use credits, please refer to the TMN Frequently Asked Questions (“FAQs”). The credits shop feature is accessible from the game menu.

a) Credits Use and Sales
Users are fully responsible for their own credits and how they are used or transferred. Users may only sell or trade Credits for TMN money, items or properties. It is not allowed to buy or sell anything outside the TMN service using TMN credits. To prevent scams, we highly suggest to use the Trading Center (a feature of the service) to transfer credits for other in-game items.

b) Credits Scams
The TMN 2010 Staff will in no case handle credits scams, any transaction of credits is at the sole responsibility of the sender of credits.

c) Credits in a future round
Game rounds of TMN usually last somewhere between 4 and 7 months. Since credits sales support the service, part of the credits purchased during the current round may be transferred to the next round. The percentage of credits refunded in the next round will be published close to the launch date of a new round.

d) Fraud
In case of fraud, we reserve the right to blacklist your name, TMN 2010 account, IP address, e-mail address or Paypal account from the TMN 2010 Service. The game owner (Bitter IT) may also provide personal details of the buyer to a third party to investigate, appeal or prevent future claims or cases of fraud to Bitter IT or third parties.
4. SERVICE ADMINISTRATION
Moderators are chosen by the game Administrators and are not considered players (they are also not bound by the TOS). Instead, moderators are bound by the Moderator’s Code of Conducts (MCOC). They are in charge of TMN2010 and reserve the right to ban or IP-ban any user who violates or violated the TOS in any way. Administrator(s) are allowed to access your account for security/investigation, or other purposes that they feel appropriate. Moderators and administrator(s) are also in charge of moderating the forum(s), but can be assisted by Forum Moderators. Forum Moderators are in charge of the forum(s) only, and are still subjects to Terms of Services. Forum Moderators may delete or lock topics and posts if they feel these topics violate the Communication Policy (also included in the Terms Of Service). They may also choose to forumban any player who violates the Communication Policy. The forum privileges Forum Moderators have may not be used for personal gain or against users not violating the Communication Policy. If Forum Moderators ignore these terms, the consequences may include banning of their account. Users can appeal the decision of a Forum Moderator at any time by contacting a Moderator.
In order to moderate the game and check that you don't violate any of the terms, moderators may send messages (including so-called "Script Tests") to which you must reply following instructions in the message. If no reply is received by the moderator within 15 minutes, but you did gain rank, you may be banned for scripting (section 8 of the TOS).
5. INTERNET SERVICE PROVIDER (ISP)
- You are responsible for obtaining access to TMN and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access TMN.
- The use of proxy servers of any kind for access to any of TMN pages or services are strictly prohibited. If a player is caught using proxy server, their account or IP may be banned immediately.
6. REGISTRATION POLICIES
Registration of an account with TMN requires you to provide us with accurate, current and complete information about yourself, as asked on the Registration page. You must provide us with your current e-mail address, which will be a contact method to be used between you and us. Providing an invalid, incurrent or temporary email address will lead to deletion/ban of account, with or without notification.
7. COMMUNICATION POLICIES
TMN offers many ways to communicate with other players, such as public profiles, the Game Forum, and the messaging system. In order to keep TMN a nice place to be for everyone, you are bound by some rules regarding communication with other players and community members:
- General rules
Treat others (including enemies) with respect. Harassing, attacking, threatening, provoking, name calling, insulting or bothering other users, forum moderators or game moderators will only be tolerated within limits.
Avoid racial/ethnic, political or religious topics. This includes posting images or links to other websites containing images that promote racial/ethnic hatred.
Do not respond to, comment on, or post content that breaks the rules. When found such content, please report it to a moderator who will take care of it.
Do not spam pages of TMN with text or other media (this includes posting the same content multiple times). Do not post content that contains advertising, solicitations, links to other games.
Do not discuss disciplinary actions. The TMN team will not discuss actions and asks that you do not either.
Be yourself. Impersonating a member of the TMN staff is not allowed.
Do not post pornographic material, and keep nudity to a minimum – kids play TMN as well.
- Forums
The forums are available to The Mafia Network (“TMN”, “TMN2010”) players to share ideas, give advice and converse about all things TMN with other players. To use the TMN forums, you must agree to follow the general Communication Policy, but as the forums are more commonly used than other methods of communication, forums are being monitored by Forum Moderators as well, and different kinds of disciplinary actions are used for violations on the forums.
The rules in the Communication Policy above explain what behavior is expected of you and other players. The rules may not address all manners of offensive behavior, and we reserve the right to evaluate each incident on an individual basis. As such, the forum and game moderators will have full discretion to address behavior they feel is inappropriate. Your access to the forums is a privilege; we reserve the right to suspend your access to the forums at any time, for reasons that are not necessarily limited to your adherence to the forum rules.
8. GAME FEATURES
Players are fully responsible to report bug(s) that they encounter during the game. Exploiting of the bug, spreading, and/or denial of reporting the bug(s) will lead to deletion/ban (of any kind) of the account. Players are also responsible for what they bet on casino games and their uses of TMN money or other properties. No money or property will be refunded, except in the case of a verified bug and approved for refund (of game money/property) by the game owner.
Cheating and/or any form of illegal access to the game features are absolutely prohibited in the service of TMN. The following are considered but not limited to cheating and/or illegal access:
- Using any kind of program or script that automatically does any actions on any game or service feature.
- Having multiple accounts. (Duplicates)
- Exploiting and/or using a bug in the game for any reason.
- Selling or trading accounts, items or properties of TMN for accounts, items or properties of another game and vice versa. Items include (but are not limited to) cars, money, bullets and credits.
- Selling or trading accounts, items or properties of TMN to anything outside TMN. This includes but is not limited to real-life money.
9. PRIVACY POLICY
TMN collects personal information when you register as a player. When you use TMN products or services, when you visit TMN pages and when you participate in any of services provided by the game itself or another service from Bitter IT.
- When you register your account, we may ask for personal information. Once you register with TMN and sign in to our services, you are not anonymous to us.
- The service automatically receives and records information on our server logs from your browser, including your IP address, TMN cookie(s) information, and the page you request.
- The service uses information for the following general purposes: to customize the advertising and content you see, fulfill your requests for products and services, improve our services, contact you, conduct research, and provide anonymous reporting for internal and external clients.
- We will not rent, sell, or share personal information about you with other people or nonaffiliated companies except to provide products or services you've requested. An exception to this is when we have your permission, when the laws allow (or forces) us to do so, or in case of fraud or serious violations of the TOS. No Moderator or Administrator will release or reveal your personal information to anyone at any time, this might include you when you for any reason lost access to the e-mail address you used to register the account.
- The service may store and access cookies (only cookies that are set by TMN website) on your computer.
- TMN Administrators have the right to check your private messages and your personal notepad if we have reason(s) to suspect any violation of the TOS. Such suspicion may be based on reports from other players.
10. ACCOUNTS
- As mentioned above, no more than one active (alive and not banned) account is allowed per player.
- Users are ONLY allowed to access their own account. Sharing, selling or trading of accounts is not permitted. Logging on to someone else’s account is not permitted. Anyone caught on someone else’s account is subject to the banning of both/all accounts on the IP address at the sole discretion of the Administrator/Moderator.
- It is NOT allowed to interact with other users who use or have used the same IP address you do. This means you cannot send monetary goods (money, credits, bullets), properties, networks or businesses. You also are not allowed to be in the same Organized Crime or Drugs Transportation Mission.
- In addition to the above rule, it is also NOT allowed to have indirect transactions of monetary goods, properties, networks or businesses. Sending goods to another player / other players to pass on to (eventually) someone on an IP address you have used, is not allowed.
- Players are fully responsible for what they do with their passwords and/or usernames. We are not responsible for the loss of passwords, and are unable to recover them. We advise players to choose a safe and un-guessable password that is different from passwords used on any other service not part of Bitter IT.
- The TMN staff will not be responsible for any actions by players that result in the hacking or killing of an account, this includes visiting any website. We advise players to log out of the service before visiting websites they don't recognize.
- If a user’s account gets hacked or accessed by another player, TMN is not responsible for the undoing of any results of said hacking. This includes the return of any Money, Credits, Cars, Properties and any other goods of TMN, as well as the revival of killed accounts or un-banning of the account. Once reported, Administrators or Moderators will investigate and ban any users involved directly or indirectly in said hacking.
- Accounts that have been banned for any reason lose all rights to any Money, Credits, Cars, Properties or any other game possessions remaining on the account. The only exception to this rule is when an account is banned shortly after having spent money on the service in return for credits, if these credits have not yet been spent and were not (part of) the reason for the ban. The decision to make this exception can only be made by an administrator of the service.
- Accounts that have been killed lose all rights to any Money, Cars, Properties or any other game possessions on the account with the exception of Credits.
11. PROPERTIES SCAMMING
- Players are fully responsible for what happens to their money/properties. Players are required to use the provided Trading Center to trade/sell their properties with other players. The TMN Staff team will not be responsible and will not return your properties if they are scammed by other player(s). This includes game money, credits, and any other kind of properties in the game.
- The only exception to a property refund is if it was lost due to a verified exploit or bug, in which an TMN Administrator may approve a return based on his sole judgement.
